Possible Legal Issues?

Posted by PurplePrawn - July 5th, 2013

So I'm going to start taking commissions soon, but I want to know, how legal is it to make a profit off of art based almost exactly off of existing copyrighted art? I mean, I'm trying to make adult parodies of cartoons that look as close to the real thing as I can, and make a profit off of that. I know TV shows and things make parodies, but they always change the art style or mix together different things, so I want to know if doing pornographic parodies of cartoons is technically legal.

After carefully reviewing "fair use" I believe that if I keep sound clips from the shows to a minimal then I will be safe.

It is legal as long as you give fair mentioning that if the cartoon is copyrighted, that it is, and that it is just a parody. Its a different game for each form of media; television , music, and internet copyright laws all differ. As long as you can give fair mention to the holders of the copyright, you should be perfectly fine.

I figured. I'll just put a disclaimer before my videos like Zone

Look at Zone, or whatever its called. That guy makes all hentai version of real shows, even uses the audio from the show.

I know, but I'm pretty sure I've heard of them getting sued before, or something like that

Zone had to have one of their cartoons removed at one point, because they used an excessive amount of sound from the show I think, which is copywritten voice talent in use. Just be wary, and try to only use their moaning and stuff when you need to.

Yeah, that's what I thought. I also thought maybe they got threatened because they use so many actual video clips from the original show too. I'm probably not gonna use any video clips, just some audio

Aw man, I gotta tell ya. When Zone made that parody of Foster's Home for Imaginary Friends, the creators told him to remove it, and threatened to sue (don't know if they did, though) because it looked too close to the original.
Your artwork is super close to the actual show too. Seriously, I though Jake face-raping Marcy was a TV .gif or something at first. So... I dunno...
